What is Probate?
Probate is a certificate which is sealed and stamped by the Supreme Court Of Victoria. This certificate determine the legal validity of the will and grant it’s approval. A probate can be grant to the only executor who is appointed under the will.
Is Probate always needed?
No. Probate is necessary for following situations:
- Valuation of assets is higher than certain amount of dollars.
- Property was owned by testator as joint proprietors or owned any business as joint ventures.
How to get probate?
Obtaining probate is a quite long time-consuming process.
This process includes the following steps:
- Submitting the application to the Supreme Court. This application should contain detailed information about the testator, executor, will, and estate.
- The application should be done according to the rules of the Supreme Court. The intention to apply for probate should be explained clearly in the application.
- Once application is being received by court , it get assessed and approved probate get delivered.
